In dealing with the US Citizenship and Immigration Services (USCIS), obtain legal counsel or find an accredited representative to assist in the process of filing applications or petitions. Those applying or petitioning for anything on behalf of others need to file a Form G-28 – Notice of entry of appearance as an attorney or representative
Make sure an attorney or accredited representative files documents with the USCIS. A Notary Public, Notario or immigration consultant cannot make presentations. Be wary of people posing as attorneys or accredited representatives. Inside the US borders only attorneys/accredited representatives may to talk to the USCIS and get information back. Outside the US borders a practicing lawyer/attorney in that country may act on a person's behalf. Those unable afford a lawyer/attorney should see free or low cost immigration legal services. Attorney's chosen to represent a person in an immigration hearing or naturalization procedure has to be in good with their Bar Association in their State. They must be able to practice and not be banned or barred in any way by their State licensing authority. Anyone seeking legal representation should take the time to check on the background of their attorney of choice before any money changes hands. Ask to see the attorney's license to practice. If this request is refused, it's best to seek other counsel. Notary publics, notarios and immigration consultants may not represent anyone, nor give legal advice of any sort. They are not qualified in legal or immigration and naturalization matters. They may charge a small fee for helping to fill out USCIS forms. Notarios in the United States are not attorneys. Beware of whom spending money to an unqualified person for advice on immigration issues.
