Houston immigration lawyer Annie Banerjee is pleased to offer consultation to those who desire to enter the United States under a little-known provision in US Immigration Law; the “Extraordinary Ability” clause grants EB-1 classification to the applicant, under certain documentable criteria.

EB-1 is the highest level of employment-based admission to the United States. Applicants filing for US citizenship under this status will be required to provide specific documentation indicating that they operate at the highest echelon of their artistic, scientific, education, business, or athletic field. The documentation acceptable as legitimate evidence under this program is widely varied: major international prizes, widely-read scientific journals, proof of salary significantly larger than others in similar careers—the breadth and complexity of the law is staggering, and can only be properly parsed by a qualified Houston immigration attorney.

Academics without the distinction of major prizes may also qualify for preferential citizenship under the “Outstanding Professor or Researcher” clause of EB-1 Law. Regardless of salary, aliens who can objectively document their excellence in research or instruction in their field may be granted this status. Acceptable evidence that the criteria have been met include scholarly publications, scientific or artistic achievement, serving as judge of others in the same field, or being the subject of inquiry by others in the field.
